These terms govern your access and use. The website is operated by Aucto Inc. With its affiliates and subsidiaries, “ Aucto ”, “ we ”, “ our ” or “ us ”, and the services set forth therein. Aucto ‘s Privacy Policy, the Aucto Website Terms and Conditions, any Seller ‘s Terms, and the terms and conditions of any other agreement you may have with Aucto are included in these Bidder ‘s Terms. The other agreement will control in the event of a conflict between these Bidder ‘s Terms and any other agreement. The user can accept these Bidder ‘s Terms by using the site and clicking below.

There are definitions.

Aucto ‘s bidding technology automatically places a bid on behalf of a Bidder up to the Bidder ‘s Max Bid.

A person holding a Verified Bidder Account is a bidder.

Max bid is the highest amount entered by a Bidder that the Bidder is willing to pay for a lot in an Online Auction or Webcast Auction.

An online auction is an event where all bidders are required to bid online.

A seller is someone who is approved to sell on the site.

The services include browsing the site, communicating with sellers, bidding in online auctions, and purchasing items for sale.

Upon receiving a valid and accepted credit card, a purchasing account is verified by Aucto. Aucto ‘s Marketplace can be used to purchase items and register for online auctions.

The term Webcast Auction means an auction event where people can bid online or in person.

There is an account and user access.

You must have a verified bidder account to access and use the Services. The Aucto Website Terms and Conditions include a reference to a user account.

Aucto has the right to remove or alter any part of the Services at its sole discretion.

You agree that Aucto ‘s ability to provide the Services may be hindered or interrupted by technical problems caused as a result of internet connectivity issues, faults in Aucto ‘s Website, network, technology, server, software and hardware or errors caused by Auc. Any damages, real or perceived, caused by Technical Malfunctions will not be deductible by Aucto.

The seller received approval.

Each Seller hosting an Online Auction and/or Webcast Auction on the site has the right to review Bidder profiles and accept or reject bids at their sole discretion.

Each Seller has the right to request additional information or a monetary deposit as a condition to approve a Bidder to participate in their sale event.

Aucto is not a party to any agreement between a Bidder and a Seller.

Placing bids.

Upon approval from the seller, bids may be placed on the lot they wish to purchase. The Bidder with the highest bid on each lot will be considered the winning bidder, pending approval from the seller.

You can place a max bid in an online auction. Absentee bids will be placed on your behalf if you place a Max Bid.

There may be a time extension for Online Auctions on Aucto. If a bid is placed on a lot in the last minute before the time expires on that lot, the bidding time on that lot will be extended for a pre-determined period of time.

The leading online bid will be communicated by Aucto in a Webcast Auction. You agree that any bid you place is subject to the approval of the seller. The Seller has the right to reject or accept any bid communicated by Aucto.

It is considered final and binding once a bid is placed. The seller may give express permission for a bidder to remove or cancel a bid.

By placing a bid on a lot, the Bidder acknowledges and agrees to abide by all terms set forth in this agreement.

The results of the auction may be published by the seller. You agree that bids placed on the site may be seen by the public.

You agree that an auction event or lot for sale may be removed from the site and excluded from a sale at the seller ‘s sole discretion.

There are purchase and sale agreements.

If you are the winning bidder in an auction, or if you purchase an item from the site, you will be entering into a purchase and sale agreement with the seller. All risk and liability associated with any agreement you enter into with a Seller on the site is assumed by you as the Bidder.

Aucto does not review or evaluate the condition, quality or origins of the items sold or verify the claims made by each seller regarding its items listed for sale on the site.

Aucto does not have control over the governing terms of sale events set out by sellers on the site.

It is not a party to any purchase or sale contract you enter with the seller on the site.

Any warranty of any kind, express or implied, on any items listed for sale on the site is the responsibility of AUCTO. Unless stated otherwise, all items should be considered as-is, where-is.

Aucto will not be held liable for the actions of any seller on the site.

Aucto does not charge any fees to register an account on the site.

You agree that any item you bid on or purchase on the site may be subject to the following charges, in addition to the bid amount.

You will be solely responsible for and liable for all taxes, duties, tariffs, fees, and other assessments, and related interest and penalties. You agree to indemnify, defend and hold harmless Aucto from any and all obligation or liability to pay Taxes.

Aucto Payment Gateway can be used to process payments. Buyers can pay via wire transfer or credit cards with Aucto Payment Gateway. Credit cards will only be accepted for orders under $ 5000.

Aucto buyer ‘s premium is paid.

Some items may be subject to an Aucto Buyer ‘s Premium. When you place a bid on the item or add it to your cart, the amount of the Aucto Buyer ‘s Premium will be clearly displayed.

The Aucto buyer ‘s premium is due immediately upon receipt of the invoice.

When a Bidder makes a payment to the Seller using Aucto ‘s Payment Distributor, the Aucto Buyer ‘s Premium is automatically paid to Aucto. You agree to pay the Aucto buyer ‘s premium. You agree that any Aucto Buyer ‘s Premium due will be deducted from the payment you make to the seller.

If taxes apply to the Aucto Buyer Premium, they will be added to the invoice.

Bidder obligations

You agree to abide by the Aucto Website Terms and Conditions and Privacy Policy.

You agree that you are solely responsible for performing any due diligence on any item you wish to bid on or purchase on the site.

Placing a bid in an auction-style event, making an offer to purchase, or committing to buy an item on the site is a legally binding obligation. If you are the successful buyer, you agree to pay the amount of your bid, plus all applicable taxes and charges and any buyer ‘s premium, in the time and manner designated by the Seller.

You agree to comply with the Seller ‘s Terms, as posted on each particular auction, liquidation, or sale, and with all applicable laws, rules, and regulations. If you fail to pay any amounts owed, Aucto may, in it ‘s sole discretion, temporarily or permanently terminates your user account and/or deny you access to the site, and Aucto reserves the right to exercise any and all rights, and pursue any and all legal

You agree that Aucto will not act as an agent for any Bidder or seller.

You agree that Aucto can monitor a Bidder ‘s bidding history, login history and other browsing history which it may make available to a Seller upon request.

There are modifications.

We have the right to alter, modify or change these Bidder ‘s Terms at any time and in our sole discretion. We do n’t make any commitment to update the materials. Alteration, modification or change will be effective immediately upon posting on the website, and you waive any right you may have to receive specific notice of such alterations, modification or change. To understand the terms and conditions that apply to your use of the site, be sure to review the Bidder ‘s Terms and all applicable policies. You must stop using the site and services if you do n’t agree with the terms. Following the posting of any alterations, modifications or changes, your continued use of the site constitutes your acceptance.

The venue is governing law.

The Bidder ‘s Terms will be governed by the laws of the State of Ohio, without regard to any conflicts of laws principles. The state courts of the State of Ohio, Fulton County and the U are the only places where these Bidder ‘s Terms will be heard. The exclusive personal jurisdiction of venue in the District Court of the Northern District of Ohio is given to the parties here. They waive trial by jury if the defense is based on forum non conveniens or lack of jurisdiction.

There are some things that are Miscellaneous.

You will not assign any of your rights or delegate any of your duties without the prior written consent of Aucto. The headings in these Bidder ‘s Terms are only for reference and will not affect the interpretation of these Bidder ‘s Terms. No agency, partnership, joint venture, or employment relationship is intended or created by these Bidder ‘s terms. The parties agree that any provision of these Bidder ‘s Terms that is found to be invalid or unenforceable will be modified to the extent necessary to permit its enforcement to the maximum extent permitted by applicable law. No failure or delay in exercising any right under these Bidder ‘s Terms will preclude any other or further exercise of such right or any other right. The provisions of these Bidder ‘s Terms will inure to the benefit of the parties hereto, their heirs, successors, and permitted assigns.
